Any individual or legal entity placing an order on the nicochona.com website that is validated via our secure payment platform is considered a "customer." We reserve the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order.

You understand and agree that any use, reproduction, resale, or simple communication, written or oral, of the products, services, and content offered by this site is strictly prohibited without the written consent of this site and its representatives and will be systematically prosecuted.

You understand and agree that when you submit a written or oral testimonial about one of this site's products or services, it becomes the property of the site, which implies the transfer of the right of reproduction, editing, and publication. Unless you request otherwise in writing, this publication may mention your first name, as well as your profession and place of residence.

Article 3: Ordering

Any order placed on a website belonging to us implies full and unreserved acceptance of these general terms and conditions of sale.

Article 3bis: Subscriptions to the Member Area

Registration in the Member Area (CLUB) constitutes a paid subscription according to the chosen package:

Custom: $10 per month, automatically charged each month.

Goldtop: €100 per year, 12-month commitment with a single annual payment.

The subscription gives you access to live Masterclasses, their replays, and other exclusive content available only to members.

Monthly subscriptions can be canceled at any time via the member account; access remains active until the end of the period already paid for.

Annual subscriptions are valid for 12 months from the date of purchase; early termination is not possible, except under legal conditions.

By subscribing, you agree that access to the Member Area content will be provided digitally and immediately after payment confirmation, in accordance with applicable legislation on digital services.

The personal and payment information provided when registering for the Member Area is collected and used exclusively to manage your membership, your access to Masterclasses and exclusive content, and to keep you informed of club news, in accordance with our Privacy Policy.

Article 4: Price

Prices are quoted in euros, including all taxes, excluding shipping and handling costs for your order.

As a self-employed entrepreneur, the company benefits from the VAT exemption threshold. VAT is therefore not applicable in accordance with Article 293 B of the General Tax Code.

The prices of items may be changed at any time. However, the price applied to an order will be the price advertised at the time of ordering.

Article 5: Payment

Payment is due immediately on the date of order, including for pre-ordered products. You can pay by credit card.

The information transmitted is encrypted by state-of-the-art software and cannot be read during transmission over the network. Any guarantee regarding the security of this system is entirely the responsibility of the bank and cannot be attributed to us.

Article 6: Availability and delivery

Orders will be processed while stocks last. Orders are prepared and delivered as soon as possible after they are placed, but we cannot guarantee a specific delivery time as this depends on the availability of Nico Chona and his teams.

Article 7: Pre-order

For "pre-order" products, i.e. those that you can purchase before their official release date, payment is due immediately at the time of ordering.

The estimated release dates for products are not binding.

We do our best to meet the estimated dates we provide, however the actual dates often depend on factors beyond our control (e.g. printing delays, vinyl pressing delays, natural disasters).

Article 8: Right of withdrawal, return and refund conditions

Unless otherwise stated on the product description page, any paid order for one of our products cannot be canceled in accordance with Article L 121-20-2 of the Consumer Code relating to the right of withdrawal.

Article 9: Liability

We cannot be held liable for the non-performance of the contract concluded in the event of unforeseeable circumstances, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flooding, fire, acts of terrorism, or acts of war. nicochona.com shall not be liable for any indirect damages resulting from the present circumstances, operating losses, loss of profit, damages, or costs that may arise.

Article 10: Masterclasses & Events

The organizer accepts no responsibility for damage, loss, or theft of equipment occurring during a masterclass or event, nor for personal injury or accidents.

Participants agree that images (photos and videos) taken during the masterclass or event may be made public, whether for commercial purposes or not.

Article 11: Protection of personal data

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access and correct any personal data concerning you.

Article 12: Applicable law

All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions referred to therein, shall be subject to French law.
